1. Acceptance of Terms

By accessing elitenestsystem.com or engaging Elite Nest System LLC ("Elite Nest System," "we," "us"), you agree to these Terms & Conditions. If you do not agree, please do not use the website or our services. These terms do not replace your signed renovation contract, which governs any specific project.

2. Our Services

Elite Nest System provides residential renovation and remodeling services — including kitchen, bathroom, living room, bedroom, dining room, and basement renovations — across selected U.S. states. Service availability varies by location; we confirm availability before any agreement is made.

3. Website Content & Estimates

Starting prices, timelines, and package descriptions shown on this website are illustrative reference points only. They are not offers, guarantees, or binding quotes. Every project receives a written, fixed-price proposal after an in-home consultation, and that signed proposal is the sole binding statement of scope and price.

4. Renovation Contracts & Scope

All renovation work is performed under a written contract signed by both parties, which specifies scope, materials, schedule, payment milestones, and change-order procedures. In the event of any conflict between this website and a signed contract, the signed contract controls.

5. Payments

• Projects follow a milestone payment schedule defined in your contract — a modest deposit, stage-based progress payments, and a final payment after your approval walkthrough.
• We accept the payment methods listed in your contract. Late payments may accrue the late fees stated therein and may pause work until resolved.
• Deposits are handled in accordance with applicable state contractor-funds regulations.

6. Change Orders

Any change to the contracted scope — materials, layout, or finishes — must be documented in a written change order signed by both parties, stating the price and schedule impact, before the changed work begins. Verbal requests are not binding on either party.

7. Client Responsibilities

You agree to: provide safe, lawful access to the work area during agreed hours; secure pets and valuables; make selections within the design-phase deadlines; and promptly report concerns to your project manager. Delays caused by unavailable access or late selections may adjust the schedule accordingly.

8. Permits, Codes & Inspections

Unless your contract states otherwise, Elite Nest System obtains required permits, schedules inspections, and ensures work complies with applicable building codes. Work will not proceed in violation of code at the client's request.

9. Warranties

Projects include a 5-year transferable workmanship warranty as detailed in your contract, covering defects in our installation and labor. Manufacturer warranties on materials and appliances apply separately and are passed through to you. The warranty excludes ordinary wear, client or third-party damage, unauthorized alterations, and moisture events from sources outside our scope.

10. Limitation of Liability

To the maximum extent permitted by law, Elite Nest System's total liability arising from any project is limited to the amount paid by you under that contract. We are not liable for indirect, incidental, consequential, or punitive damages. Nothing in these terms limits liability that cannot be limited by law.

11. Intellectual Property

All website content — text, design, imagery, logos, and 3D design concepts we produce — is the property of Elite Nest System LLC or its licensors. Design concepts and plans are licensed to you for your specific project upon full payment and may not be reused or resold.

12. Website Use

You agree not to misuse this website: no scraping, unauthorized automated access, interference with operation, or submission of false or unlawful information through our forms. We may suspend access for abusive behavior.

13. Dispute Resolution & Governing Law

These terms are governed by the laws of the State of Georgia, USA. Project disputes are first addressed through good-faith negotiation with your project manager and, if unresolved, through the dispute process in your signed contract. Nothing here prevents either party from pursuing warranty claims or statutory remedies.

14. Termination

Either party may terminate a project contract as described therein, with written notice and settlement of work completed to date. Website access may be terminated by us at any time for violation of these terms.
